USCIS premium processing services

The USCIS has started allowing petitioners to file the Form I-129, Petition for a Nonimmigrant Worker, from February 24. Through this form petitioners can request for a change or extension of their status to E-3 classification and request for premium processing of their petition.

This E-3 classification is applicable only to Australian nationals who intend to come to the United States only to work in a specialty occupation.

Australian nationals can apply for an E-3 nonimmigrant visa from outside the US directly by contacting the Department of State. For those nationals who are already in the U.S, they can fill the Form I-129 with the USCIS.

These are the eligibility requirements to qualify for the E-3 classification:

  • Must be a national of Australia
  • Must have a legitimate job offer in the United States
  • Must have the required academic and other qualifying credentials
  • Must have the qualifications to fill a specialty occupation

In case the applicants want to speed up the adjudication of specific forms, then they can use the premium processing services of the USCIS by paying additional filing fees. The processing will then be generally completed within 15 days.
