Temporary foreign workers to be protected through 13 amendments

IRCC and ESDC announced amendments to the Immigration and Refugees Protections Regulations so that more protection can be given to temporary foreign workers. There are 13 amendments that will be used for the protection of workers and it will also enhance the Temporary Foreign Workers Program.

ESDC stated that new amendments will protect TFWs from mistreatment and abuse in Canada. Here are the conditions to be followed:

  • It will be mandatory for all employers to inform the TFWs about their rights in Canada.
  • Reprisal by employers against workers will be prohibited.
  • Employers will not be able to charge any recruitment fees from workers.

Other responsibilities of employers towards TFWs

Employers have to provide access to healthcare services along with private health insurance. ESDC stated that amendments will enhance the program’s ability for the inspection of workplaces and enforcement of all rules. The program will also administer the consequences if rules are not followed. One of these consequences can be the cancellation of LMIA.

Similar meetings will be held to improve the TFWP and additional measures can be added which include:

  • Enhancement of inspection tools and mandatory training to improve the quality of inspections.
  • Workers can come with complaints regarding abuse or mistreatment through the enhanced tip line service.
  • Employers will be continuously made aware about their obligations for temporary foreign workers.
  • Collaboration with consulates, local authorities, and provinces will be enhanced so that immediate action regarding a complaint can be taken.

Rights of TFWs in Canada

Temporary foreign workers enjoy the same rights given to Canadian citizens and permanent residents. Employers have to provide a safe working environment to the workers. Employers have to pay wages along with overtime. A signed copy of the offer letter should be given to employees before their first day of work.
